California Consumer Privacy Act Notice

Effective Date: April 30, 2024

As a California resident, under the California Consumer Privacy Act (as amended) (the “CCPA”), you have the right to know what personal information we collect, how we collect it, why we collect it and with whom we share it. As used herein the terms “Transamerica,” “we”, “us” or “our” refers to the Transamerica company with which you have a relationship (for a list of potential companies, please see below).

We may collect or use personal information differently depending on your relationship with us.  Please click on one of the following links for more information:

Consumer – you are an individual purchasing a product or service from us or using our websites or mobile applications in your individual capacity. The CCPA does not apply to: (i) personal information that is subject to the federal Gramm-Leach-Bliley Act (“GLBA”); or (ii) health information subject to the federal Health Insurance Portability and Accountability Act (“HIPAA”). For example, this Notice is not applicable to policyholders or individual customers who have or are using our financial or health products and services primarily for personal, family or household use. If the foregoing applies to you, federal law requires that we provide you with a separate privacy notice. Such notices can be viewed here (see “Additional Privacy Notices”).

Business Contact – you have a business relationship with Transamerica, such as an agent, consultant, or contractor.

Job Applicant – you have applied for a job with Transamerica.

Your California Consumer Privacy Rights

As a California resident, you may have certain rights to make requests regarding your personal information (“Consumer Requests”). Summaries of these rights are set forth here; please see the full applicable privacy notice linked above for additional details regarding our privacy practices and your rights. Request to Know

As a California resident, you have the right to request Transamerica provide you with a disclosure that includes the following: 

• The categories of personal information we have collected about you in the preceding 12 months; 

• The categories of sources from which the personal information was collected; 

• The business or commercial purpose for collecting, selling, or sharing (for cross-context behavioral marketing) your personal information; 

• The categories of third parties with whom we have disclosed your personal information; and 

• The specific pieces of personal information about you we have collected. 

And, with respect to any personal information that we have either sold or shared (for cross-context behavioral marketing), if any, or disclosed for a business purpose in the preceding 12 months, a disclosure that includes the following: 

• The categories of personal information we have collected about you; 

• The categories of personal information we have sold or shared (for cross-context behavioral marketing), if any, about you, and the categories of third parties to whom your personal information was sold or shared (for cross-context behavioral marketing); and 

• The categories of your personal information we disclosed for a business purpose. 

Please note that Transamerica is not obligated to respond to a California resident’s Request to Know more than twice in any 12-month period.

Request to Correct

You have the right to request that Transamerica corrects inaccurate personal information that we maintain about you.  If you have an account with us, you may have the ability to correct certain information when you’re logged into your account. 

Once you submit the Request to Correct form, we will request details of what is to be corrected and support for the correction.  We will need to verify your identity before we make any changes to your personal information.

Request to Delete

As a California resident, you have the right to request Transamerica delete any personal information about you that we have collected from you. This right is subject to Transamerica’s legal rights or obligations to retain such personal information (for example, we have a legal obligation to retain information regarding your account while your account is active and for at least seven years thereafter, we are required to retain a record of your deletion request, we may retain data in archive systems, etc.). Please note that once we delete your information, we cannot restore it.

Request to Opt-Out of the Sale or Sharing (for cross-context behavioral marketing) of My Personal Information 

As a California resident, you have the right to opt-out of the sale or sharing (for cross-context behavioral marketing) of your personal information by Transamerica to a third party. While we generally do not sell personal information, some personal information under the Demographic, Identifying, or Consumer categories may be considered a sale in the course and scope of certain marketing efforts (all consistent with our obligations under other applicable laws and regulations). We do not sell the personal information of minors under the age of 16. 

Request to Opt-Out

 

  • Transamerica collects certain sensitive information. We do not use or disclose sensitive information in a manner that requires us to offer a right to limit such use under the CCPA.
  • Transamerica does not use automated decision-making tools to process your personal information in a manner that requires us to offer a right to limit such processing under the CCPA.
  • Transamerica does not discriminate against your for exercising your privacy rights under the CCPA.  We may, however, charge different prices or rates, or provide a different level or quality of goods or services, if that difference is reasonably related to the value provided to us by your personal information.

  • We may limit our response to your rights as permitted by applicable law.

 

Verification Process and Authorized Agents

Upon receipt of a Consumer Request, we will seek to verify your identity to our reasonable satisfaction before responding. This may require you to submit personal information to us during the verification process. You may authorize another individual to submit a Consumer Request on your behalf through the means indicated above. We may require the authorized agent to provide proof of your signed permission to submit the request and may require you to do one of the following: i) verify your identity directly with us; or ii) directly confirm to us that you have provided the authorized agent permission to submit the request.
